Finding the 'Loophole'

The vast majority of motorists who receive a speeding ticket never bother to challenge it.  They believe they must have been speeding and just accept what the police say.  When the Notice of Intended Prosecution arrives in the post most people panic and in an attempt to avoid going to court simply accept the points and the fine.

This means that the police are lulled into a false sense of security. They are not accustomed to motorists refusing to accept the word of the police. What’s more, as legal aid is not available for most driving offences, the police do not expect solicitors to become involved in the case.  As a result, the police do not always do what they should!

Marcus believes that around 50% of cases he has defended and won have been cases where the police or the Crown Prosecution Service made a technical mistake early on in the case.  This resulted in these cases being dropped even though his clients may, or may not, have been speeding.
