Speeding
Marcus A Johnstone is an experienced speeding defence solicitor who is trained to find the legal ‘loophole’.
Speeding is a criminal offence and can result in a criminal prosecution against you. It is vital that you obtain expert advice as soon as possible, especially if you have received a Notice of Intended Prosecution or have been asked to attend court by way of a Summons. However, by instructing Marcus to act as your representative, you may never need to attend court.
Failing to identify the driver now carries 6 points and a fine so it is important to follow a set procedure. If there is more than one driver of your vehicle you my have a defence of ‘reasonable diligence’ – something the police never tell you about!
Being caught by a speed camera will cost you 3-6 penalty points as well as a fine. The court may also ban you from driving if your speed is in excess of 30% over the limit.
However, by taking expert legal advice now you may be able to avoid penalty points or a ban completely. Marcus specialises in finding the ‘loophole’ and aims to stop your case ever reaching court. Marcus has represented motorists over several years and regularly finds mistakes made by the police and the Crown Prosecution Service.
‘Totting-Up’
Once you accumulate 12 points (within a 3 year period) you will automatically be banned for 6 months under the ‘totting-up’ procedure. How would you cope with being off the road? Would you lose your job or business? Would you be able to pay your mortgage and bills if you couldn’t work?
Losing your licence can have disastrous consequences and this is where Marcus is able to help. He will immediately be able to halt the proceedings against you whilst he obtains all the available evidence from the police and the prosecution. If he is not provided with the correct documents then the case may never reach court. If a mistake has been made by the police or he is able to find a legal ‘loophole’ then the case may be dropped and no further action will be taken against you.
Even if you have already pleaded guilty Marcus is often able to convince the court that ‘mitigating circumstances’ exist and therefore you should not receive a driving ban. It is, therefore, possible to keep your licence even if you reach 12 points or more.
Speeding law involves many evidential, procedural and legal technicalities. Marcus believes that around 75% of cases he has defended and won have been cases where the police or the Crown Prosecution Service made a technical mistake early on in the case. By finding mistakes or loopholes many of these cases were then dropped before ever reaching court, even though his clients may, or may not, have been speeding.
